THE LEVETT LETTER &THE LEVETT LOUNGE

1. DESCRIPTION OFSERVICES
The Levett Letter and The Levett Lounge (herein after referred to as the "Services") are advisory publications and membership services providing strategic intelligence on the women artists market, offered by FAMM - Femmes Artistes du Musée de Mougins, a simplified joint stock company(SAS) registered in the Trade and Companies Register of Cannes under number 512676 560 00034, whose registered office is located at 5 rue des Mûriers, 06250 Mougins, France, represented by Ms. Leisa PAOLI in her capacity as President (hereinafter referred to as "FAMM").
The Levett Letter is a monthly advisory publication providing strategic insights on women artists market opportunities, institutional momentum, and acquisition guidance.
The Levett Lounge is an exclusive membership service including The Levett Letter plus additional benefits such as live webinars, private events, collection access, and direct advisory opportunities.
2. SUBSCRIPTION TERMSAND PRICING
2.1 Pricing
The Levett Letter:
€2,400 per year (excluding applicable taxes)
The Levett Lounge:
€12,000 per year (excluding applicable taxes)
2.2 Payment Terms
Subscriptions are payable annually in advance. Payment must be completed before access to the Services is granted.
2.3 Taxes
Prices are stated excluding taxes. Applicable VAT willbe added according to the subscriber's location and status: French individuals and companies: French VAT (20%) applies EU companies with valid VAT number: Reverse charge mechanism applies (0% VAT) Non-EU subscribers: Generally no VAT applicable
2.4 Currency
All prices are stated in Euros. Payment must be made in Euros.
3. SUBSCRIPTION PROCESS
3.1 Registration
To subscribe, the customer must complete the registration form available on our website, providing accurate and complete information including: Full name and contact details Professional function and company Billing address VAT number (if applicable)
3.2 Acceptance
Subscription requests are subject to FAMM's acceptance. FAMM reserves the right to refuse any subscription request without providing justification.
3.3 Confirmation
Upon acceptance and payment confirmation, the subscriber will receive access credentials and the subscription will commence.
4. ACCESS AND DELIVERY
4.1 The Levett Letter
Monthly digital publications delivered via email Access to password-protected online collection Digital delivery typically occurs on the last business day of each month
4.2 The Levett Lounge
All benefits of The Levett Letter Monthly live webinars Invitation to three annual private events (transportation and accommodation at subscriber's expense) Access to advisory services (additional fees may apply) Priority customer support.
5. DURATION AND RENEWAL
5.1 Initial Term
Subscriptions are for a one-year period from the date of payment confirmation
.5.2 Renewal
Subscriptions will automatically renew for successive one-year periods unless cancelled by the subscriber with 30 days' written notice before the renewal date.
5.3 Price Changes
FAMM reserves the right to modify subscription prices with 60 days' advance notice. Price changes will apply from the next renewal period.
6. CANCELLATION ANDREFUNDS
6.1 Cancellation Policy
Subscribers may cancel their subscription with 30days' written notice. Cancellation takes effect at the end of the currentsubscription period.
6.2 Refund Policy
No refunds will be provided for partial subscription periods except in cases of material breach by FAMM or technical impossibility to provide the Services.
6.3 Early Termination
FAMM may terminate a subscription immediately in case of: Non-payment of subscription fees Breach of these terms and conditions Misuse of the Services or content
7. INTELLECTUAL PROPERTY
7.1 Content Ownership
All content provided through the Services, includingbut not limited to text, images, analysis, and recommendations, remains the exclusive property of FAMM and/or its licensors.
7.2 Permitted Use
Subscribers may use the content for personal, non-commercial purposes only. The content is strictly confidential and may notbe: Reproduced, distributed, or shared with third parties Used for commercial purposes Modified or adapted without express written permission
7.3 Collection Access
Access to The Levett Collection online is strictly personal and non-transferable. Subscribers may not share access credentials or content with third parties.
8. CONFIDENTIALITY
8.1 Non-Disclosure
All information provided through the Services is confidential. Subscribers agree not to disclose, share, or distribute anycontent, insights, or information received through the Services to any third party without FAMM's express written consent.
8.2 Investment Decisions
The Services provide educational and informational content only. FAMM does not provide investment advice, and subscribers make investment decisions at their own risk and responsibility.
9. LIABILITY ANDWARRANTIES
9.1 Service Availability
FAMM endeavors to provide uninterrupted access to theServices but cannot guarantee continuous availability. FAMM shall not be liablefor temporary service interruptions due to maintenance, technical issues, orcircumstances beyond its control.
9.2 Content Accuracy
While FAMM strives to provide accurate and up-to-date information, it makes no warranties regarding the completeness, accuracy, or reliability of the content provided through the Services.
9.3 Limitation ofLiability
FAMM's liability is limited to the amount paid by the subscriber for the current subscription period. FAMM shall not be liable for any indirect, consequential, or punitive damages.
9.4 Investment Risks
Subscribers acknowledge that art investment carries inherent risks, and FAMM accepts no responsibility for any financial losses resulting from investment decisions made based on information provided through the Services.
10. PERSONAL DATAPROTECTION
10.1 Data Processing
FAMM processes personal data in accordance with applicable data protection laws and its Privacy Policy, available on our website.
10.2 Data Use
Personal data is used solely for providing theServices, managing subscriptions, and communicating with subscribers about the Services.
10.3 Subscriber Rights
Subscribers have the right to access, rectify, delete,or port their personal data by contacting FAMM at the address provided below.
11. FORCE MAJEURE
FAMM shall not be liable for any delay or failure to perform its obligations due to circumstances beyond its reasonable control, including but not limited to natural disasters, government actions, war, terrorism, or pandemic-related restrictions.
12. GENERAL PROVISIONS
12.1 Entire Agreement
These terms and conditions constitute the entireagreement between FAMM and the subscriber regarding the Services.
12.2 Modifications
FAMM may modify these terms with 30 days' advance notice. Continued use of the Services after such notice constitutes acceptance of the modified terms.
12.3 Severability
If any provision of these terms is found invalid, the remaining provisions shall remain in full force and effect.
12.4 Governing Law
These terms are governed by French law. Any disputes shall be submitted to the competent courts of the jurisdiction where FAMM's registered office is located.
